Terms of Service

1. E-Commerce

Payments

My online shop uses Stripe to ensure secure payments by credit card with no sensitive data going through my server.

Canadians can choose to send me an e-transfer at [email protected] or contact me for other arrangements.

Payment for prints are handled through Newfoundland Canvas on their secure shopping platform.

Payment in full is required before delivering a service online or shipping a product. Payment plans may be available for original art. Contact me at [email protected] to enquire.

Shipping

Original artwork will be shipped within 1-3 business days after full payment, except for commissions. I will discuss timing for these before you make your purchase. Prices do not include shipping. Please contact [email protected] to get a quote before making a purchase or I’ll contact you once you’ve processed your order.

Prints require up to 10 business days to print and are handled through Newfoundland Canvas . For local orders, they can be picked up at Newfoundland Canvas, 56 Aberdeen Ave St. John’s, NL A1A 5T3. in St. John’s. Other orders will be shipped by courier directly from Newfoundland Canvas . You’ll be notified with a tracking number when your order has been shipped.  As we’re on an island in Canada, shipping can take approximately 2 weeks. Please contact them directly with questions and concerns.

Please note that countries outside of Canada may charge extra taxes or duties on the shipment (at the time of delivery or afterward). These are the responsibility of the customer.

Returns and Refunds

A. Custom Services

As a lot of time and energy goes into preparing for and delivering custom intuitive readings, guided meditations, and Soul Energy Portraits, there are no refunds. Please send me any questions you may have prior to hiring me.

B. Original Paintings

Original paintings of medium/large sizes will have special plywood crates built for them to protect from damage. UPS insurance up to their maximum value can be purchased. Shipping is charged at cost – I will contact you once I receive the quote from the shipper.

There are no refunds or exchanges for the original paintings you have purchased should you change your mind upon receipt. It is very important to me that you be happy with the art you are adding to your collection, so please contact me at [email protected] with any questions you might have before making your purchase.

If your package arrives visibly damaged, please refuse receipt and have the courier note the damage. Please contact me as soon as possible to discuss a replacement or refund. If damage is only discovered once opened, contact me (with pictures) at  [email protected] to discuss whether you would like a replacement or return. Claims not reported within 3 business days of receiving product cannot be guaranteed a full credit. Please keep in mind that return shipment in original packaging is at your expense, but the replacement will be on me.

Please note that the digital images I display have the most accurate color possible. However, due to differences in computer monitors, I cannot be responsible for variations in color between the actual product and your screen. The craftsmanship at Newfoundland Canvas, is of top quality.

2. Comments

This site allows users to comment on articles. Comments are generally unpublished until approved. Comments deemed spam by Akismet will be automatically filtered out and never posted. For those comments that post, if I deem them spam, defamatory, offensive, obscene, libelous, or infringing on others intellectual property I will remove them. If your comment is manually removed for any of these reasons, I will contact you via the email address provided in your comment to discuss the removal.

3. Intellectual Property

This site contains intellectual property owned by me, the artist Dominique Hurley, including trademarks, copyrights, and other intellectual property. However, I want you to share my content. If you would like to do so, please use no more than a single paragraph and the accompanying photo and provide a link back to the original article or website. Feel free to use the Share buttons below products and pages. Any use beyond this is not authorized without my prior written consent. If you would like to obtain consent, please email me at [email protected].

As the artist, I retain copyright on all photographs and paintings. Please do not reproduce my artwork in any manner, either for personal or commercial use. If in doubt or if you’d like to purchase a license to use the art for a project, please contact me at [email protected].

Please note that I also retain copyright on Soul Energy Portraits, but will not reproduce or license the photographs of these for commercial purposes.

Privacy Policy

This site collects information on you in two ways.

  1. The information that you manually provide by leaving a comment, filling out one of my contact forms, signing up for my blog and / or e-newsletter, or making a purchase. This information can be tied directly to you because of the information you’ve provided.

To avoid learning your credit card information, I’ve partnered with Stripe, and Square (for in-person use or electronic invoicing) to securely process online payments. As such, only they learn or store your credit card information. Neither I or my providers ever access this information.

The information collected via your comments, contact, or blog & Mail Chimp sign-up form is only shared with others if required by our terms of service/agreement with those parties, or if we are legally required to by law. I hate SPAM. I do not share your information with anyone who isn’t directly linked to the operation of this site / business. 

Also, you are not added to my mailing list on MailChimp unless you specifically request it (via opt-in form or in person). You can always unsubscribe at any time using the link at the bottom of the newsletter. I am not responsible for what happens after you leave my site or unsubscribe from my mailing lists.

  1. The information that’s automatically collected via third-party partners included on this site in order to allow me to deliver relevant content to you. For example, I use Google Analytics, Word Press Jetpack Statistics, MailChimp Reports, and Facebook Pixels.

The types of information collected here include location, IP address, and pages visited. Generally, my third-party partners only give me this information in the aggregate (e.g. it’s not identifiable to you).

I use this to better understand my readers, create more content that you love, and to target ads to segments of my list or website visitors via Facebook.
